The 2016 “Loi Montagne” provides for the obligation to hold winter equipment (snow tires, or winter tires or anti-skid devices such as chains or "socks") in defined areas, from November 1st until March 31st of the following year. The driver of the vehicle, whether it is a passenger vehicle or a commercial vehicle, must have one of these devices in certain cities in 48 metropolitan departments. The details of the law are specified in the Decree n° 2020-1264 of October 16, 2020.
If an accident occurs in a "Loi Montagne" area and the vehicle does not have the appropriate winter equipment, the person will be considered responsible (no one can ignore the law) and the insurance company may not cover the possible repairs.
